2. Scope of Services
Mark McKellar provides ski instruction, mountain guiding, safety training, and other outdoor adventure services, subject to availability and client suitability.
All services are conducted in compliance with safety regulations and local laws.
3. Booking Policy
Bookings are confirmed only upon receipt of full payment or an agreed deposit.
Clients are responsible for providing accurate personal details during booking.
Once confirmed, all bookings are subject to the cancellation and refund policies outlined below.
4. Payment Terms
Payments can be made via Bank transfer and Revolut.
Prices are listed in EUR (€) and include all applicable taxes unless otherwise stated.
Refunds for cancellations are subject to the cancellation policy outlined below.
5. Cancellation and Refund Policy
Cancellations by the Client:
More than 30 days before the service: Full refund.
Between 15-30 days: 50% refund.
Less than 15 days: No refund.
5.1 Non-Attendance
If a participant fails to attend a booked session for personal reasons, no refund or replacement session will be offered.
Examples include but are not limited to:
Travel delays or cancellations (e.g., missed flights, traffic issues).
Illness or injury prior to the lesson or hike.
Failure to arrive at the agreed location on time.
Any other personal circumstances.
5.2 Lift Closures and Force Majeure
In the event of cancellations or disruptions to activities due to circumstances beyond Mark’s control, no refunds will be issued.
Examples include but are not limited to:
Lift closures caused by weather conditions or mechanical failure.
Dangerous or extreme weather making the activity unsafe.
Closure of the resort or area due to natural disasters, pandemics, or other extraordinary events.
Mark will provide, where possible, alternative arrangements such as rescheduling the session or a document for insurance claims.
6. Client Responsibilities
Clients must:
Disclose any medical conditions, injuries, or disabilities that may affect their participation.
Provide their own equipment unless explicitly agreed otherwise.
Follow safety instructions and guidelines provided by Mark.
Mark is not liable for injuries, accidents, or loss of property arising from non-compliance with safety guidelines.
7. Civil Liability and Insurance
Mark McKellar holds the appropriate qualifications and insurance to provide guiding and instruction services.
Participants must acknowledge that outdoor activities, including skiing, hiking, and mountain guiding, carry inherent risks.
All participants must hold valid civil liability insurance that covers any damage or injury they may cause to others during the session.
Mark McKellar reserves the right to request proof of insurance before the activity.
Mark is not liable for injuries or accidents beyond his control, including those resulting from weather conditions or third-party negligence.
7.1 Medical, Rescue, and Accident Insurance
All participants must have appropriate insurance covering medical emergencies, rescue operations, and accidents related to the activities booked. This includes but is not limited to: skiing, ski touring, snowboarding, snowshoeing, and off-piste adventures.
The insurance must include rescue and repatriation services, such as helicopter evacuation if required.
Failure to provide proof of adequate insurance may result in the participant being refused service, with no refund issued.
7.2 Emergency Situations
For minor participants, Mark will contact the designated emergency contact in the event of an incident.
For adults, or in cases of extreme urgency, participants agree that Mark or relevant authorities (e.g., ski patrol or medical personnel) may authorise emergency medical treatment if necessary.
All costs incurred during medical emergencies or rescues are the participant's responsibility.
8. Privacy Policy
Personal data collected through the website is handled in accordance with the General Data Protection Regulation (GDPR).
Data is used solely for booking, communication, and improving services.
Clients have the right to access, modify, or delete their data.
9. Intellectual Property
All content on this website, including text, images, and logos, is the property of Mark McKellar unless otherwise stated.
